PRIVACY POLICY FOR PERSONAL DATA PROCESSING – registration to Videolibrary
in accordance with Art. 13 of Regulation (EU) 679/2016 and Art. 13 of Italian Legislative Decree 196/2003 as amended and supplemented.
RAI COM S.p.A., with registered office in Via Umberto Novaro, no. 18 – 00195 Rome (RM), Tax Code and VAT No. 12865250158, (hereafter, “RAI COM”) - in the capacity of Processing Controller - performs all personal data processing activities (“Data”), in respect of principles of lawfulness, correctness and transparency and in conformity with the rules in place to protect the rights and fundamental freedoms of natural persons, in accordance with Regulation (EU) no. 2016/679 (hereafter, “GDPR”) and Italian Legislative Decree dated 30 June 2003 no. 196 as amended and supplemented.
The Videolibrary is a RAI COM service aimed at operators of the film and/or audio visual industry and it includes over 2,000 titles, 500 feature films and 4,000 hours of television programming including series, films, documentaries, animations, operas, concerts, ballets and restored classics. By accessing the Videolibrary, operators can view contents potentially of interest for their activity in the industry of distribution of audio visual contents.
To register to the Videolibrary of RAI COM, at the section of the website International Sales (http://www.raicomvl.rai.it/register) and/or another indicated area, just enter your Name, Surname, e-mail address, company name and/or company of belonging and country of origin. No other information is necessary for the purposes of performing the service.
By completing the form, the data subject (hereafter “the Data Subject”) authorises RAI COM to process the Data communicated and consents to the processing purposes described below, therein including the activation of the access credentials and all activities connected to the display of contents.
Processing purposes
In fulfilment of the obligations provided by existing regulations, RAI COM processes the Data communicated in respect of principles of lawfulness, correctness and transparency, accuracy and minimisation of risks, for the exclusive purpose of providing the service of access and display of the Videolibrary. The Data communicated may be viewed, in performing the management activities of the internet website, by RAI – Radiotelevisione italiana S.p.A., which acts in the capacity of Processor.
Processing methods and data storage times
The Data Processing is implemented by means of the operations indicated in Art. 4 of Italian Legislative Decree 196/2003 and Art. 4 no. 2) GDPR and in particular through the operations of: collection, registration, organisation, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, block, communication, erasure and destruction of data. The Processing is performed with the use of electronic tools, suitable to protect, at all times, the confidentiality and rights of the data subject in respect of the provisions of existing regulations.
The Data collected will be stored, in conformity with the provisions of Art. 5 letter e) of the GDPR and the regulations in force in that regard, for a period of time not exceeding that necessary to achieve the purposes for which they are processed. Suitable security measures are observed to prevent the loss of Data, unlawful or incorrect uses and unauthorised accesses.
In any case RAI COM will adopt all measures to avoid using those Data indefinitely, appropriately verifying on a periodic basis the continuing interest in processing those Data.
Nature of provision, consequences of refusal and communication of data
The collection of Data is optional and any refusal involves the impossibility of using the Videolibrary service.
The Data are used exclusively within Italy, for the indicated purposes and they will not in any way be communicated to third parties, disseminated and/or in any case transferred further.
Rights of the Data Subjects
In accordance with Articles 15 et seq. of the GDPR, the Data Subject has the right, at any time, to request access to the Data and to check its accuracy and/or to request its supplementation, update, rectification, erasure, restriction, therein including the right to object to processing for marketing purposes and/or sending of sales communications. The data subject also has the right to revoke consent to the processing of the data, at any time, without prejudice to the lawfulness of processing based upon the consent provided before the revocation.
The GDPR confers the exercise of the following specific rights:
- confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data (right of access):
- the rectification of inaccurate personal data, or the right to have incomplete personal data completed (right of rectification);
- the erasure of those data where one of the grounds provided by the Regulation applies (right to be forgotten);
- the restriction of processing where one of the circumstances provided by the Regulation applies (right to restriction);
- to receive in a structured, commonly-used and machine-readable format the personal data provided by him or her to the controller and the right to transmit those data to another controller (right to portability).

Without prejudice to any other administrative or jurisdictional appeal, the Data Subject has the right to make a complaint to the Data Protection Supervisor, if he or she believes that the processing violates the GDPR.
